Falcon Health and Wellness:
Assumption of the Risk and Waiver of Liability Relating to Coronavirus/COVID-19
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people.
Falcon Health and Wellness, PLLC has put in place preventative measures to reduce the spread of COVID-19; however, Falcon Health and Wellness, PLLC cannot guarantee that you will not become infected with COVID-19 and/or that you are not already an asymptomatic carrier of COVID-19. Furthermore, receiving services at Falcon Health and Wellness, PLLC could increase your risk of contracting COVID-19. By signing this agreement, You acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that You may be exposed to and/or infected by COVID-19 by receiving services at Falcon Health and Wellness, PLLC and that such exposure and/or infection may result in personal injury, illness, permanent disability, and/or death.
Furthermore, You understand that the risk of becoming exposed to and/or infected by COVID-19 at Falcon Health and Wellness, PLLC may be in direct or indirect result from the actions, omissions, and/or negligence of our employee(s) and/or others, including, but not limited to, the owners and employees of other massage therapists practices that share in the common space at Falcon Health and Wellness, PLLC. In consideration for being permitted to receive services at Falcon Health and Wellness, PLLC, You voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to yourself (including, but not limited to, personal injury, disability, and/or death), illness, damage, loss, claim, liability, and/or expense, of any kind, that You may experience and/or incur in connection with receiving services at Falcon Health and Wellness, PLLC.
On Your behalf, and on behalf of Your heirs, executors, administrators, personal representatives, and/or assigns, You hereby release, covenant not to sue, discharge, and/or hold harmless Falcon Health and Wellness, PLLC and all of its known/unknown parties, holdings, assets, its employees, agents, and/or representatives, of any and from any claims, including any and all liabilities, claims, actions, damages, costs and/or expenses of any kind arising out of and/or relating thereto as mentioned above regarding the Coronavirus/COVID-19.
Furthermore, You understand and agree that this release includes any and all claims based on the actions, omissions, or negligence of Falcon Health and Wellness, PLLC, its employees, agents, and representatives, on whether a COVID-19 infection occurs before, during, and/or after receiving services at Falcon Health and Wellness, PLLC. It is your right to not sign this form, but doing so, services from Falcon Health and Wellness, PLLC will be cancelled. Falcon Health and Wellness, PLLC is a privately owned business and reserves all rights to deny any and all services to anyone attempting to utilize our facility and/or services.
